Please read these Terms carefully. Section 15 contains a binding arbitration agreement and a class action waiver that affect how disputes are resolved. You may opt out of arbitration within 30 days as described in Section 15.

1. Agreement to These Terms

These Terms of Use ("Terms") are an agreement between you and World Insurance Network, Inc., a Nevada corporation doing business as WIN Insurance Agency ("World Insurance Network," "WIN," "we," "us," or "our"). They govern your access to and use of this website, the forms and features on it, and the email and text message programs you join through it (together, the "Website"). By using the Website or submitting a form, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Website. If you use the Website on behalf of a business, you represent that you are authorized to accept these Terms for that business.

2. Eligibility

You must be at least 18 years of age to use the Website.

3. General Information Only

Website content is provided for general informational purposes. It is not legal, tax, accounting, medical, regulatory, employee benefits, or individualized risk management advice, and no agent or broker relationship is created by your use of the Website alone. Insurance advice is provided only through direct communication with a licensed producer about your specific circumstances. Consult qualified professionals about legal, tax, medical, and regulatory matters.

4. No Insurance Is Bound Online

A website form, email, voicemail, text message, document upload, quote request, or payment does not bind, change, renew, reinstate, or cancel insurance. Coverage begins only when an authorized insurer or its authorized representative confirms in writing that coverage has been bound. The policy issued controls every coverage question. Our Insurance Disclaimer is part of these Terms.

5. Licensing and Availability

We solicit, negotiate, and sell insurance only in states where we hold the required license. Our current licenses are listed in our Insurance Disclaimer. Products, insurers, programs, and limits vary by state and applicant and may not be available to you.

6. Information You Submit

You agree that information you submit is accurate, complete, and yours to provide. Do not submit patient information, medical records, Social Security numbers, account credentials, payment card information, or other sensitive information through a general website form or ordinary email. Contact us for a secure transmission method. Our handling of information is described in our Privacy Policy, Consumer Health Data Privacy Policy, and HIPAA Notice.

7. Permitted Use

You may use the Website only for lawful purposes and in accordance with these Terms. You may not:

  • interfere with or disrupt the Website, its servers, or its security features
  • attempt to gain unauthorized access to any part of the Website or any system or data
  • introduce viruses, malicious code, or other harmful material
  • use robots, scrapers, or other automated means to access or collect content or data without our written permission
  • use Website content to train artificial intelligence or machine learning models without our written permission
  • impersonate any person or misrepresent your affiliation with any person or business
  • submit false, misleading, or fraudulent information
  • use the Website to violate the rights of others or any law

8. Ownership of Content

The Website and its text, design, graphics, logos, and other content are owned by or licensed to World Insurance Network and are protected by copyright, trademark, and other laws. You may view and print pages for your personal or internal business use in evaluating our services. No other right to copy, reproduce, publish, modify, distribute, or create derivative works is granted.

9. Text Message Terms

If you provide your mobile number and consent to receive text messages from WIN Insurance Agency, you agree to receive recurring automated informational and, if you separately consented, marketing text messages at that number, including messages about your inquiry, quotes, renewals, appointments, policy service, and our insurance programs. Consent to marketing text messages is not a condition of any purchase.

  • Reply STOP to cancel at any time. You will receive one message confirming your opt out.

  • We send marketing text messages only between 8:00 a.m. and 8:00 p.m. in your local time.
  • Mobile carriers are not liable for delayed or undelivered messages.
  • Mobile telephone numbers, text messaging opt in data, and consent are not shared with or sold to third parties or affiliates for their marketing or promotional purposes.

You agree to notify us promptly if you change or give up the mobile number you provided.

10. Outside Websites and Services

The Website may link to or include services provided by insurers, regulators, and other companies. We do not control and are not responsible for their content, availability, privacy practices, or security. Your use of them is governed by their own terms and privacy notices.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the Website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and noninfringement. We do not warrant that the Website will be uninterrupted, secure, or free of errors or harmful components. We may change, suspend, or discontinue any part of the Website at any time.

12. Limitation of Liability

To the fullest extent permitted by law, World Insurance Network and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, or data, arising from or related to your use of or inability to use the Website, and our total liability for all claims arising from or related to the Website will not exceed one hundred dollars ($100). These limitations apply only to your use of the Website. They do not limit any obligation we owe you under an insurance policy, a written agreement for our services, or any law that cannot be limited by agreement, and they do not apply to liability for gross negligence, fraud, or willful misconduct.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless World Insurance Network and its officers, directors, employees, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Website.

14. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws principles, except that the Federal Arbitration Act governs Section 15. Subject to Section 15, any action relating to these Terms or the Website must be brought exclusively in the state or federal courts located in Clark County, Nevada, and you and we consent to the personal jurisdiction of those courts.

15. Arbitration Agreement and Class Action Waiver

Scope. You and World Insurance Network agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or communications sent or received through or as a result of the Website, including emails, text messages, telephone calls, and the use of cookies, pixels, and similar technologies, and including claims under privacy, wiretap, consumer protection, and telephone consumer protection laws ("Dispute"), through binding individual arbitration and not in court. This Section does not apply to disputes about the terms of an insurance policy, claims against an insurer, or services we perform under a separate written agreement, which are governed by that policy or agreement and applicable law.

Informal resolution first. Before starting arbitration, the party asserting a Dispute must send a written notice describing the Dispute and the relief requested, signed personally by that party. Notices to us go to World Insurance Network, Inc., Attn: Legal, 11035 Lavender Hill Drive, Suite 160‑212, Las Vegas, Nevada 89135, with a copy by email to info@worldinsnetwork.com. The parties will attempt in good faith to resolve the Dispute for 60 days after the notice is received, and statutes of limitations are paused during that period.

Arbitration rules. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules if you are an individual using the Website for personal, family, or household purposes, and otherwise under its Commercial Arbitration Rules, in each case as modified by this Section. The rules are available at adr.org. The arbitration will take place in Clark County, Nevada, or by video conference, or, for an individual, in the county where you reside if you prefer. A single arbitrator will decide the Dispute. The arbitrator may award the same individual relief a court could award, and the decision may be entered as a judgment in any court with jurisdiction.

Costs. Payment of filing, administration, and arbitrator fees will be governed by the AAA rules. If you are an individual and your claim seeks less than $10,000, we will pay all such fees except the portion of your filing fee that does not exceed the fee to file a lawsuit in court, unless the arbitrator finds your claim frivolous.

Delegation. The arbitrator decides all issues about the interpretation, scope, applicability, and enforceability of this Section, except that a court decides issues relating to the class action waiver, the mass filing procedure, and the opt out.

Class action waiver. You and we may bring claims against each other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person or preside over any form of class or representative proceeding. If this waiver is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and decided by a court in Clark County, Nevada after all arbitrable claims are resolved.

Mass filings. If 25 or more similar demands for arbitration are filed against us by or with the help of the same or coordinated counsel, the demands will be administered in batches of up to 25, with one arbitrator per batch, and the remaining demands held until each batch is resolved, unless the parties agree otherwise. Statutes of limitations are paused for held demands.

Exceptions. Either party may bring an individual action in small claims court if it qualifies, and either party may seek injunctive relief in court to stop infringement or misuse of intellectual property or unauthorized access to systems.

Jury trial waiver. To the extent any Dispute proceeds in court rather than arbitration, you and we waive any right to a jury trial.

Your right to opt out. You may opt out of this arbitration agreement by sending an email to info@worldinsnetwork.com with the subject "Arbitration Opt Out" and your name, address, and email address within 30 days after you first accept these Terms. Opting out does not affect any other part of these Terms.

Changes. If we change this Section, the change will not apply to any Dispute of which we had notice before the change.

16. Changes to These Terms

We may revise these Terms by posting an updated version with a new Last Updated date. Revised Terms apply to use of the Website after they are posted, except as stated in Section 15. Material changes will be announced on our homepage before they take effect.

17. General Terms

These Terms, together with the policies and notices they reference, are the entire agreement between you and us about the Website. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. Sections 8 and 11 through 17 survive any termination of your use of the Website.
